Pokud jste u&nbsp;jednoho zam\u011bstnavatele vedena jako na&nbsp;&#8220;mate\u0159sk\u00e9&#8221; a&nbsp;chcete si p\u0159ivyd\u011blat n\u011bkde jinde, je to mo\u017en\u00e9 a&nbsp;nemus\u00edte nic hl\u00e1sit.<\/p>\n<p><span style=\"color: #ff6600;\"><strong>CO KDY\u017d SI BUDU P\u0158IVYD\u011aL\u00c1VAT U&nbsp;P\u016eVODN\u00cdHO ZAM\u011aSTNAVATELE?<\/strong><\/span><\/p>\n<p>Nab\u00eddl v\u00e1m zam\u011bstnavatel p\u0159i odchodu na&nbsp;&#8220;mate\u0159skou&#8221; mo\u017enost brig\u00e1dy a&nbsp;p\u0159iv\u00fdd\u011blku b\u011bhem t\u00e9to doby nebo byste se cht\u011bla po&nbsp;\u010dase vr\u00e1tit na&nbsp;p\u00e1r hodin t\u00fddn\u011b? Super, i&nbsp;to je mo\u017en\u00e9. Jen zde pozor. Podle z\u00e1kon\u00edku pr\u00e1ce\u00a0<strong>nesm\u00edte u&nbsp;stejn\u00e9ho zam\u011bstnavatele<\/strong> vykon\u00e1vat pr\u00e1ce, kter\u00e9 jsou<strong> stejn\u011b druhov\u011b vymezeny.\u00a0<\/strong>Jin\u00fdmi slovy, pokud budete uzav\u00edrat jinou pracovn\u00ed smlouvu, DPP nebo DP\u010c u&nbsp;p\u016fvodn\u00edho zam\u011bstnavatele, <strong>mus\u00ed b\u00fdt sjednan\u00fd druh pr\u00e1ce odli\u0161n\u00fd<\/strong> od toho v&nbsp;p\u016fvodn\u00ed pracovn\u00ed smlouv\u011b.<\/p>\n<p><span style=\"color: #ff6600;\"><strong>KOLIK SI M\u016e\u017dU P\u0158IVYD\u011aLAT?<\/strong><\/span><\/p>\n<p>P\u0159ivyd\u011blat k&nbsp;mate\u0159sk\u00e9 si m\u016f\u017eete <strong>bez omezen\u00ed<\/strong>. Jedin\u00e9, co mus\u00edte dodr\u017eet, abyste nep\u0159i\u0161la o&nbsp;rodi\u010dovsk\u00fd p\u0159\u00edsp\u011bvek, je zabezpe\u010den\u00ed <strong>osobn\u00ed, celodenn\u00ed a&nbsp;\u0159\u00e1dn\u00e9 p\u00e9\u010de o&nbsp;d\u00edt\u011b. <\/strong>Do takov\u00e9 p\u00e9\u010de se \u0159ad\u00ed i&nbsp;situace, kdy d\u00edt\u011b <em>(mlad\u0161\u00ed\u00a0 ne\u017e 2 roky)<\/em> chod\u00ed do<strong> jesl\u00ed, mate\u0159sk\u00e9 \u0161kolky nebo d\u011btsk\u00e9 skupiny\u00a0 max. 46 hodin m\u011bs\u00ed\u010dn\u011b.\u00a0<\/strong>Dvoulet\u00e9 a&nbsp;star\u0161\u00ed d\u011bti se ne\u0159e\u0161\u00ed, jejich doch\u00e1zka se nesleduje a&nbsp;m\u016f\u017eete tak pracovat, p\u0159ivyd\u011bl\u00e1vat si a&nbsp;pob\u00edrat &#8220;rodi\u010d\u00e1k&#8221; bez jak\u00e9hokoliv omezen\u00ed.<\/p>\n<p><span style=\"color: #ff6600;\"><strong>JAKOU FORMOU SI M\u016e\u017dU P\u0158IVYD\u011aLAT A&nbsp;JAK\u00c9 JSOU PODM\u00cdNKY?\u00a0<\/strong><\/span><\/p>\n<p>Zam\u011bstn\u00e1n\u00ed na&nbsp;HPP <em>(hlavn\u00ed pracovn\u00ed pom\u011br)<\/em> se b\u011bhem mate\u0159sk\u00e9 nevylu\u010duje, ale nej\u010dast\u011bj\u0161\u00ed jsou n\u00e1sleduj\u00edc\u00ed 2 formy \u010d\u00e1ste\u010dn\u00e9ho \u00favazku, kter\u00e9 rozepisuji n\u00ed\u017ee v&nbsp;textu. Samoz\u0159ejm\u011b p\u0159ivyd\u011bl\u00e1vat si m\u016f\u017eete i&nbsp;jako<em> OSV\u010c na&nbsp;\u017eivnostensk\u00fd list<\/em>, kdy je va\u0161e \u010dinnost vedena jako vedlej\u0161\u00ed.<\/p>\n<ul>\n<li><span style=\"color: #ff6600;\"><strong>DPP (<em>dohoda o&nbsp;proveden\u00ed pr\u00e1ce)\u00a0<\/em><\/strong><\/span>tato forma spolupr\u00e1ce je omezena na&nbsp;<strong>300h ro\u010dn\u011b<\/strong> u&nbsp;ka\u017ed\u00e9ho zam\u011bstnavatele. P\u0159i pr\u00e1ci na&nbsp;DPP nesm\u00edte podle z\u00e1kon\u00edku pr\u00e1ce odpracovat v\u00edce ne\u017e 12 hodin b\u011bhem 24 hodin. Pokud vyd\u011bl\u00e1v\u00e1te do&nbsp;10.000,- hrub\u00e9ho, pak se z&nbsp;\u010d\u00e1stky neplat\u00ed zdravotn\u00ed ani soci\u00e1ln\u00ed poji\u0161t\u011bn\u00ed. Pokud m\u00e1te uzav\u0159en\u00fdch v\u00edce DPP u&nbsp;r\u016fzn\u00fdch zam\u011bstnavatel\u016f, v\u00fdd\u011blky se\u00a0<strong>nes\u010d\u00edtaj\u00ed.\u00a0<\/strong>S\u010d\u00edtaj\u00ed se pouze v&nbsp;p\u0159\u00edpad\u011b, \u017ee m\u00e1te od 1 zam\u011bstnavatele v\u00edce dohod. DPP mus\u00ed b\u00fdt uzav\u0159ena <strong>p\u00edsemn\u011b\u00a0 <\/strong>a <strong>v\u00fdpov\u011bdn\u00ed lh\u016fta je 15 dn\u00ed\u00a0<\/strong><em>(zam\u011bstnavatel nemus\u00ed udat d\u016fvod).\u00a0<\/em>Pokud se ale spole\u010dn\u011b dohodnete, lze pom\u011br skon\u010dit okam\u017eit\u011b bez lh\u016fty. P<span style=\"color: #ff6600;\"><span style=\"color: #000000;\">ro zru\u0161en\u00ed se vy\u017eaduje p\u00edsemn\u00e1 forma.\u00a0<\/span><\/span><\/li>\n<li><strong>Zdan\u011bn\u00ed u&nbsp;DPP:\u00a0<\/strong>\n<ul>\n<li>Pokud si u&nbsp;jednoho zam\u011bstnavatele vyd\u011bl\u00e1te <strong>do 10.000,-,<\/strong> m\u00e1te na&nbsp;v\u00fdb\u011br:\n<ul>\n<li>V prvn\u00edm p\u0159\u00edpad\u011b u&nbsp;zam\u011bstnavatele\u00a0<strong>nepodepisujete prohl\u00e1\u0161en\u00ed k&nbsp;dani<\/strong>\u00a0a zam\u011bstnavatel strhne z&nbsp;va\u0161eho p\u0159\u00edjmu\u00a0<strong>sr\u00e1\u017ekovou da\u0148 ve v\u00fd\u0161i 15 %<\/strong>.<\/li>\n<li>Pokud prohl\u00e1\u0161en\u00ed k&nbsp;dani u&nbsp;zam\u011bstnavatele\u00a0<strong>podep\u00ed\u0161ete,<\/strong>\u00a0bude z&nbsp;va\u0161eho p\u0159\u00edjmu str\u017eena\u00a0<strong>15% z\u00e1loha na&nbsp;da\u0148 z&nbsp;p\u0159\u00edjmu<\/strong>\u00a0a\u00a0<strong>ode\u010dtou se v\u0161echny da\u0148ov\u00e9 slevy,<\/strong>\u00a0na kter\u00e9 m\u00e1te n\u00e1rok (nap\u0159\u00edklad sleva na&nbsp;vy\u017eivovan\u00e9 d\u00edt\u011b, sleva za&nbsp;um\u00edst\u011bn\u00ed v&nbsp;p\u0159ed\u0161koln\u00edm za\u0159\u00edzen\u00ed a&nbsp;podobn\u011b), to se pozd\u011bji prom\u00edtne v&nbsp;ro\u010dn\u00edm z\u00fa\u010dtov\u00e1n\u00ed dan\u00ed.<\/li>\n<\/ul>\n<\/li>\n<li>Pokud je v\u00e1\u0161 p\u0159\u00edjem <strong>vy\u0161\u0161\u00ed ne\u017e 10.000,-<\/strong>, bude v\u00e1m<strong> 15% z\u00e1loha na&nbsp;da\u0148 str\u017eena automaticky<\/strong>, da\u0148 bude ji\u017e po\u010d\u00edt\u00e1na ze superhrub\u00e9 mzdy, tj. mzdy zv\u00fd\u0161en\u00e9 o&nbsp;zdravotn\u00ed a&nbsp;soci\u00e1ln\u00ed poji\u0161t\u011bn\u00ed, kter\u00e9 za&nbsp;v\u00e1s plat\u00ed zam\u011bstnavatel.<\/li>\n<\/ul>\n<\/li>\n<li><span style=\"color: #ff6600;\"><strong>DP\u010c (<em>dohoda o&nbsp;pracovn\u00ed \u010dinnosti)\u00a0<\/em><\/strong><span style=\"color: #000000;\">v\u00e1m umo\u017e\u0148uje pracovat u&nbsp;jednoho zam\u011bstnavatele a\u017e\u00a0<strong>20h t\u00fddn\u011b <\/strong>(p\u016fl \u00favazek).<strong>\u00a0<\/strong>Je nutn\u00e9 j\u00ed uzav\u0159\u00edt <strong>p\u00edsemn\u011b<\/strong>, <strong>v\u00fdpov\u011bdn\u00ed lh\u016fta je 15 dn\u00ed<\/strong>, a&nbsp;pro zru\u0161en\u00ed se vy\u017eaduje p\u00edsemn\u00e1 forma. Tato dohoda m\u016f\u017ee b\u00fdt uzav\u0159ena na\u00a0<strong>dobu ur\u010ditou i&nbsp;neur\u010ditou.\u00a0<\/strong>V dohod\u011b mus\u00ed b\u00fdt uveden\u00a0<strong>druh pr\u00e1ce,<\/strong> rozsah<strong> pracovn\u00ed doby\u00a0<\/strong>a\u00a0<strong>doba,<\/strong> na&nbsp;kterou je dohoda uzav\u00edr\u00e1na. V&nbsp;r\u00e1mci DP\u010c je mo\u017en\u00e9 si tak\u00e9 sjednat\u00a0<strong>dovolenou\u00a0<\/strong><em>(pom\u011brov\u011b, nen\u00ed v\u0161ak mo\u017en\u00e9 si ji n\u00e1rokovat, je to jen v\u011bc dohody mezi v\u00e1mi a&nbsp;zam\u011bstnavatelem),\u00a0<\/em><strong>odm\u011bna = plat,\u00a0<\/strong><strong>m\u00edsto<\/strong> v\u00fdkonu pr\u00e1ce <strong>a zp\u016fsob,<\/strong> jak\u00fdm m\u016f\u017ee b\u00fdt dohoda zru\u0161ena.\u00a0Tento typ dohody se pou\u017e\u00edv\u00e1 v\u011bt\u0161inou, pokud zam\u011bstnavatel pot\u0159ebuje n\u011bkoho zam\u011bstnat na&nbsp;krat\u0161\u00ed \u00favazek, na&nbsp;pravidelnou \u010dinnost. Na&nbsp;jednor\u00e1zovou \u010dinnost se v\u00edce hod\u00ed dohoda o&nbsp;proveden\u00ed pr\u00e1ce.\u00a0<strong>\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 <\/strong><\/span><\/span><\/li>\n<li><span style=\"color: #ff6600;\"><span style=\"color: #000000;\"><strong>Zdan\u011bn\u00ed DP\u010c:<\/strong><\/span><\/span>\n<ul>\n<li>V\u00fdd\u011blek v&nbsp;r\u00e1mci DP\u010c se v\u00e1m <strong>zapo\u010dte do&nbsp;d\u016fchodu.<\/strong><\/li>\n<li>Pokud si vyd\u011bl\u00e1te m\u00e9n\u011b ne\u017e 2.500,- , nen\u00ed odv\u00e1d\u011bno zdravotn\u00ed poji\u0161t\u011bn\u00ed.<\/li>\n<li>U v\u00fdd\u011blku vy\u0161\u0161\u00edho ne\u017e 2.500,- je nutn\u00e9 zdravotn\u00ed a&nbsp;soci\u00e1ln\u00ed poji\u0161t\u011bn\u00ed odv\u00e9st jako u&nbsp;b\u011b\u017en\u00e9ho pracovn\u00edho pom\u011bru.<\/li>\n<li>V\u0161echna zam\u011bstn\u00e1n\u00ed mal\u00e9ho rozsahu u&nbsp;jednoho zam\u011bstnavatele se pro tyto \u00fa\u010dely se s\u010d\u00edtaj\u00ed.<\/li>\n<li>Pokud nepodep\u00ed\u0161ete u&nbsp;zam\u011bstnavatele<strong> prohl\u00e1\u0161en\u00ed k&nbsp;dani,<\/strong> tak u&nbsp;v\u00fdd\u011blku ni\u017e\u0161\u00edho ne\u017e 2.500,- odv\u00e1d\u00edte <strong>sr\u00e1\u017ekovou da\u0148 ve v\u00fd\u0161i 15 %<\/strong> (stejn\u00e9 jako u&nbsp;DPP s&nbsp;v\u00fdd\u011blkem ni\u017e\u0161\u00edm ne\u017e 10 000 korun).<\/li>\n<li>Pokud <strong>prohl\u00e1\u0161en\u00ed podep\u00ed\u0161ete<\/strong>, p\u0159\u00edjem je <strong>zdan\u011bn 15 % sr\u00e1\u017ekovou dan\u00ed<\/strong> a&nbsp;re\u017eim je stejn\u00fd jako u&nbsp;b\u011b\u017en\u00e9ho pracovn\u00edho pom\u011bru.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><span style=\"text-decoration: underline;\"><span style=\"color: #ff0000; text-decoration: underline;\"><strong>POZOR!<\/strong><\/span>\u00a0U obou dohod plat\u00ed n\u00e1sleduj\u00edc\u00ed pravidlo t\u00fdkaj\u00edc\u00ed se zdravotn\u00edho poji\u0161t\u011bn\u00ed:<\/span><\/p>\n<p>Pokud byste byla v&nbsp;situaci, kdy za&nbsp;v\u00e1s st\u00e1t zdravotn\u00ed poji\u0161t\u011bn\u00ed neplat\u00ed a&nbsp;neodv\u00e1d\u00ed ho ani zam\u011bstnavatel<em> (tedy nap\u0159.vyd\u011bl\u00e1te si na&nbsp;DPP m\u00e9n\u011b ne\u017e 10.000,- a&nbsp;nejste vedena nikde jinde jako zam\u011bstnanec &#8211; pracovn\u00ed pom\u011br v\u00e1m skon\u010dil p\u0159ed nebo b\u011bhem &#8220;mate\u0159sk\u00e9&#8221;)<\/em>, m\u00e1te <strong>povinnost se do&nbsp;8 dn\u016f nahl\u00e1sit zdravotn\u00ed poji\u0161\u0165ovn\u011b<\/strong> jako pl\u00e1tce pojistn\u00e9ho tzv. jako \u201eosoba bez zdaniteln\u00fdch p\u0159\u00edjm\u016f\u201c (OBZP). To se t\u00fdk\u00e1 t\u011bch m\u011bs\u00edc\u016f, kdy takov\u00fd stav trval <strong>cel\u00fd m\u011bs\u00edc<\/strong>.<\/p>\n<p>Vypln\u00edte formul\u00e1\u0159 <strong>P\u0159ihl\u00e1\u0161ka a&nbsp;eviden\u010dn\u00ed list poji\u0161t\u011bnce<\/strong> a&nbsp;v <strong>odd\u00edle 4. Kategorie poji\u0161t\u011bnce ozna\u010d\u00edte k\u0159\u00ed\u017ekem Pl\u00e1tcem pojistn\u00e9ho je poji\u0161t\u011bnec \u2013 OBZP<\/strong> <em>(toto je p\u0159\u00edklad pro VZP, ale u&nbsp;jin\u00fdch poji\u0161\u0165oven v\u00e1m jist\u011b r\u00e1di porad\u00ed na&nbsp;podateln\u011b \u010di z\u00e1kaznick\u00e9 lince). <\/em>Nezapome\u0148te to ud\u011blat, proto\u017ee za&nbsp;nespln\u011bn\u00ed hroz\u00ed <strong>pokuta a\u017e 10.000,- <\/strong>a\u00a0poji\u0161\u0165ovna v\u00e1m ji m\u016f\u017ee klidn\u011b ud\u011blit a\u017e po&nbsp;n\u011bkolika letech a&nbsp;je\u0161t\u011b budete platit pen\u00e1le vznikl\u00e9 na&nbsp;nezaplacen\u00e9m pojistn\u00e9m.<\/p>\n<p>Pokud tato situace ohledn\u011b zdr. poji\u0161t\u011bn\u00ed skon\u010d\u00ed, mus\u00edte op\u011bt sama prov\u00e9st vy\u0159azen\u00ed z&nbsp;t\u00e9to kategorie se stejn\u00fdm formul\u00e1\u0159em.<\/p>\n<hr \/>\n<p>Jestli jsem na&nbsp;n\u011bjak\u00fd dotaz zapomn\u011bla, n\u011bco v\u00e1m nen\u00ed jasn\u00e9 nebo chcete cokoliv probrat, r\u00e1da v\u00e1m pom\u016f\u017eu.
